REGULAR SESSION MINUTES
A Regular Session Meeting of the EAST HARTFORD PLANNING AND ZONING COMMISSION was held in the Town Council Chambers, 740 Main Street, East Hartford, Connecticut on April 11, 2007.
The meeting was called to order at 8:30 p.m.

Chairman Anthony Kayser declared a quorum present. Chairman Anthony Kayser appointed Alternate Peter Bonzani to vote in the absence of Elaine Carey, and appointed Alternate Travis Simpson to vote in the absence of John Grottole. Chairman Kayser stated that the Commission would be voting with six members.

APPROVAL OF MINUTES
Regular Session – March 14, 2007
Upon a motion by Paul Roczynski, seconded by Peter Bonzani, it was VOTED (5-0) to APPROVE the above minutes. Commission Fitzgerald did not vote on the above due to his absence.

ZONE CHANGE APPLICATION: Residence III (R-3) to Business 5 (B-5) on 0.43 acres with 0.321 acres of land requested to be changed from Residence III (R-3) to Business 5 (B-5) on land located at 10 Howard Street. Assessor’s Map #14 Lot #182
Applicant: David Holmes, Capital Studio Architects, LLC
Upon a motion by Kathleen Salemi, seconded by Paul Roczynski, it was VOTED (6-0) to APPROVE the above Zone Change Application.
SPECIAL PERMIT APPLICATION: Under Section 403.2(q) and 403.2(f) to allow a Restaurant/automobile oriented use and Drive-through facilities on land located at 300 Silver Lane.

Applicant: Hines Sudden Service, Inc.
(Application postponed from March 14, 2007 Public Hearing)
Upon a motion by Kathleen Salemi, seconded by Paul Roczynski, it was VOTED (6-0) to APPROVE the above Special Permit Application with the following conditions:
1. Final plans are to be signed and stamped (ink and impression) by the Professional Engineer and Land Surveyor.
2. Provide a plan showing existing conditions within 200 feet of the sit as per section 207.4b.3 of the regulations (read section) – Use MDC 1” = mapping – label accordingly.
3. Provide separate plans for each application – label accordingly.
4. Delivery and service vehicles shall enter from the west by making a left turn into the site, and shall exit to the east by making a left turn out of the site.
5. Delivery and service vehicles shall be scheduled as follows:
a). Mclane Foodservice – Wednesday, 1:00 a.m. and Saturday, 1:00 a.m. (WB 50 Tractor-Trailer)
b). Trash Pickup – Monday, noon and Thursday, 6:00 a.m. (SU-30 Box Truck)
c). Cardboard Pickup – Tuesday, 7:00 a.m. (SU-30 Box Truck)
d). Poultry Products Chicken – Monday, Wednesday and Friday between 9:00 a.m. and noon (SU-30 Box Truck).
SITE PLAN APPLICATION – 300 Silver Lane, Construction of an automobile oriented restaurant, drive-through facilities, parking lot and associated storm water drainage.
Applicant: Hines Sudden Service, Inc. c/o David Hines
Upon a motion by Kathleen Salemi, seconded by Paul Roczynski, it was VOTED (6-0) to APPROVE the above Site Plan Application with the following conditions:
1. In evaluating this application, the Planning and Zoning Commission has relied upon information provided by the applicant and, if such information subsequently proves to be false, deceptive, incomplete, and/or inaccurate, this permit shall be modified suspended or revoked.
2. Final plans are to be signed and stamped (ink and impression) by the Professional Engineer and Land Surveyor.
3. Provide separate plans for each application – label accordingly.
4. Layout of curb cuts, vehicle tracking movements and drainage calculations are subject to approval by the Connecticut Department of Transportation.
5. Provide a plan showing existing conditions within 200 feet of the sit as per section 207.4b.3 of the regulations (read section) – Use MDC 1” = mapping – label accordingly.
6. Revise grading of concrete landings at both doors – landings are to be level. Check and revise grades of handicap ramp and parking space accordingly.
7. Provide lines and labels for line of sight at driveway – check existing and proposed trees and shrubs.
8. Revise grades of the proposed driveway along Silver Lane – grades are to be based on the DOT driveway apron detail. Provide detail on the plans.
9. Revise limits of 8” reinforced concrete walks along the frontage of the site – 25’ to the east of the driveway apron.
10. Provide 18” concrete curbing for the site.
11. Revise the layout plan for concrete walks, expansion joints 15’ on center.
12. Revise the lighting plan to conform to section 209.6 of the regulations – maximum one-half foot candle illumination at all property lines.
13. Provide additional proposed spot grades at corners of building, all corners of parking lot, on concrete pavers, etc.
14. Provide a Waiver of Claim for connecting the proposed storm drainage system in the Town drainage system
15. Remove existing trees from storm sewer easement located along the westerly side of the site – provide low ground cover and shrubs, etc.
16. Delivery and service vehicles shall enter from the west by making a left turn into the site, and shall exit to the east by making a left turn out of the site.
17. Delivery and service vehicles shall be scheduled as follows:

Upon a motion by Kathleen Salemi, seconded by Paul Roczynski, it was VOTED (6-0) to APPROVE the above Soil Erosion and Sedimentation Application with the following conditions:
1. Final plans are to be signed and stamped (ink and impression) by the Professional Engineer and Land Surveyor.
2. Provide a plan showing existing conditions within 200 feet of the sit as per section 217.3b.2 of the regulations (read section) – Use MDC 1” = mapping – label accordingly.
3. Provide separate plans for each application – label accordingly.
SITE PLAN APPLICATION – 1379 Main Street, Construction of a parking lot and associated storm water drainage system to an existing office building.
Applicant: Capital Studio Architects, LLC
Upon a motion by Kathleen Salemi, seconded by Paul Roczynski, it was VOTED (6-0) to APPROVE the above Site Plan Application with the following conditions:
1. In evaluating this application, the Planning and Zoning Commission has relied upon information provided by the applicant and, if such information subsequently proves to be false, deceptive, incomplete, and/or inaccurate, this permit shall be modified suspended or revoked.
2. Final plans are to be signed and stamped (ink and impression) by the design engineer.
3. Remove 12 feet from the easterly side of the proposed fence located at the corner of Main and Sterling Road.
4. Provide the test pit data on the site plans.
5. Provide a 4 foot sump on the catch basin detail.
6. Remove the landscape island located to the north of the proposed walk so as to provide additional area for vehicle turning movements.
7. The two proposed trees located at either side of the driveway are to be shifted to the north.
SOIL EROSION AND SEDIMENTATION CONTROL APPLICATION - Governor Street Reconstruction from Main Street to Prospect Street.

Upon a motion by Kathleen Salemi, seconded by Peter Bonzani, it was VOTED (6-0) to APPROVE the above Soil Erosion and Sedimentation Application.

Upon a motion by Kathleen Salemi, seconded by Thomas Fitzgerald, it was VOTED (6-0) to APPROVE the reduction of the above Site Plan Modification Bond in the amount of $71,995, and to hold $33,865.00.

REVIEW OF CORRESPONDENCE FROM ATTORNEY DONALD WEISMAN REGARDING 351 SILVER LANE
It was the consensus of the Commission to add the above item to the Planning and Zoning Workshop Session scheduled for April 25, 2007.

MISCELLANEOUS
· Cardinal Health - 131 Hartland Street
Representatives of Cardinal Health, along with Development Director, Jeanne Webb, requested that the Commission determine if their pharmaceutical mixed-use business would be permitted in the current B-4 Zone.
The Commission VOTED (5-1) to allow this mixed-use business at the 131 Hartland Street location. Commissioner Salemi voted in opposition.

Upon a motion by Kathleen Salemi, seconded by Thomas Fitzgerald, it was VOTED (6-0) to APPROVE the payment of the above bill.
